My question involves unemployment benefits for the state of: California
I recieved my appeal from EDD which told me I had to go to Superior court and file a Petition for Writ of Mandate. I am a substitute teacher and during school breaks and holidays get zero work. I currently recieve unemplyment because although I recieved a resonable assurance of returning to work it took over a month to get called back to work. So I'm getting some money but I origianlly filled for unemployment in June when I knew subs dont work summer school not even 1 day. I apply every year for summer school and never even get an interview. So all summer I recieved zero dollars and zero calls. I did apply for 8 jobs to the distict and surrounding districts.
I did have an interview with an administrative law judge who did grant me unemplyment begining September, when the school year began, for this I'm thankful. But he didn't give me the summer. Over $2000 was withheld from the summer, not a lot but would really help, especially now with astromical gas prices.
Now I sent my appeal to the administratvive law judge on Dec 13, 7 days late, but I was denied. The letter reported that I needed to file a petition of writ of mandate. Now my question, should I file the mandate? Is my case one that a superior court judge would look kindly on? Is it worth it?
