    Unhappy Can You Relinquish All Rights to the Other Parent Due to a Child's Behavior Issues

    My question involves paternity law for the State of: CA

    This child has been in our home for 3yrs now with ongoing violent behavior issues towards family, objects, schbool staff. Considering letting him return to biological mother and release all parental rights.

    So presumably Dad has custody?

    He can see if mom wants custody, but he can't make her petition for custody and he can't walk away from his responsibilities to his child. If mom gets custody, he can expect to pay child support. If mom doesn't want custody, he can't just foist the child off on her merely because parenting is hard work.

    Dad got custody for a reason. Why does he think the child will be better off with mom?
