    Default Statute of Limitations for Private Student Loan

    My question involves collection proceedings in the State of: California

    I was trying to find out if I'm pass the statue of libations for my private student loan, it was with aes and now sent to marblehead for collections . I did contact aes today to get this information from them but never promised nor did they ask for payment. I did however give them my new address so I may get sued soon. I understand that ca is 4 yrs from last day of payment but I'm not sure when a payment was made as I am the cosigner and only have my credit report to go by and it states date open dec 06, first reported jan 07 and date of status jul 08. I do know that no payment has been made in the last several yrs but would like to know if any of these dates can give some insight to if I'm passed my sol with this loan? Pls advise anyone?

    It seems like you may have passed the statute of libations before typing that paragraph....

    For federally guaranteed student loans, under Section 484A(a) of the Higher Education Act, no statute of limitations applies to an attempt to enforce the debt by either the Department of Education or the guaranty agency. What type of loan was it, and was it guaranteed?

    If the loan is truly private then the state's statute of limitations should apply.

    Hmm, not really sure what that means. Perhaps if you want to type out exactly what your credit report says, or scan the relevant parts of it and post them, then maybe someone here will have a better idea as to when this went into default.
