    Default Divorce While Pregnant

    My question involves a marriage in the state of: Florida
    I am 2 months into my divorce proceedings. I am also 4 months pregnant by another man. There is no possibility of the baby being my husbands as we havent had any kind of relations since July of 2010 and he also moved out of state in Oct 2010. My husband also had a vasectomy in the spring of 2003. So as I stated there is absolutely no possible was that this child is his. I have not told my lawyer that I am pregnant and im not sure if I should because I don't know if he has a legal obligation to stop the proceedings because of my pregnancy. Also because of there being no possibility of the baby being my husbands would the court/judge possibly allow the divorce while Im pregnant.

    You need to be honest with your attorney.

    It's possible for all of you to get together, sign the correct forms and have your husband's legal paternity disestablished as part of the divorce action.

    The LAST thing you want to do is lie or conceal such an important fact.

    I do not want to keep anything from my attorney but again does he have the legal obligation to stop the divorce if I tell him? My husband is several states away so no we could not all meet, and I really dont want him to know any more of my personal business than he needs to.

    Unfortunately, you got pregnant while still married, so it's not going to stay a secret from your husband. From a legal standpoint, this child will LEGALLY belong to your husband, even if you two were on different planets for the last 50 years, until and unless the courts get involved to change that fact - either by your husband addressing it as part of the divorce, or by the actual father stepping forward to establish paternity - neither of which can happen until the child is born. For this reason, the divorce cannot be finalized until AFTER the birth (when your husband's AUTOMATIC paternity can be DISestablished). Your attorney can't protect your interests without knowing ALL of the facts, and the sooner, the better.
