    Default Speeding Ticket in Seattle

    My question involves a speeding ticket from the State of: Washington

    I just got a speeding ticket on which the officer checked "yes" to the CMV box and the Hazmat box. Does that mean he indicated I was driving a commercial motor vehicle with hazmat designation?? If so this is definitely not the case, simply a mom dropping my kid off at preschool... Does this help in contesting the ticket?

    What were you driving? From the example forms I can find there's a box next to the HAZMAT box marked "Commercial Vehicle" - what's marked in that box? Were you carrying any cargo? If so, what?

    There is a notation CMV and boxes to check (yes or no) the officer checked "yes" and a box marked HAZMAT which he checked "yes." I was driving a BMW X5 with no cargo and absolutely nothing that could be confused as cargo. I'm a stay at home mom - there could be no confusion about a commercial vehicle carrying hazardous material. I realize that courts will forgive the officer for making a minor error on the ticket (mispelling name, etc) but this seems to go to the identification of the vehicle the officer had his radar trained on... just wondering if anyone had any thoughts/experience with that or when an error on the ticket might subject it to dismissal.

    It happens to have been a ticket in a school speed zone (30 in a 20) and there are possibly some issues with the distance the speed zone is from the school (more than 300 feet) that could be challenged as well but I'm more interested in the first issue at this point.

    I wouldn't worry about the first issue. On my VERY first speeding ticket the officer checked the box for a 16+ vehicle, Meaning I was carrying more than 16 passengers. I didn't see how that was possible in a 1995 Honda Accord LX, so I took it to court on that fact alone.

    I lost.

    In your situation, the judge probably won't care. It's a minor clerical error.
