    Default Retroactive Child Support

    My question involves child support in the State of: San Antonio, Bexar County, Texas.
    My ex and I separated almost 7 years ago when he filed for divorce. Unfortunately, nothing progressed from that first court date. The only paperwork that was filed was temporary orders granting joint conservatorship of our son with him being the custodial parent. Now, at that time he did not ask for child support which was stated in the temporary orders. I want to go back to court now and I've been told by one attorney that he may be granted retroactive child support even if he declined it at the time. Is this true?

    can you define how he "declined"

    He can absolutely ask for retroactive child support. Not sure he can go back the entire 7 years but if he chose to just not ask for it and you chose not to send it, you are still obligated to make payments. The court will enforce the order.

    I feel for you!! I don't know about the laws in Texas, but I can tell you we just got an order literally yesterday in NM that even though mother admitted on the record several times that she did tell father she did not want child support that she just wanted him out of child's life and even though she signed and notarized an agreement, the Court awarded her 12 years of retroactive child support plus interest.

    Hang in there though. If anyone knows how terrible this is, it is me. I have been crying my eyes out for quite some time.

    WOW! I really hope that, that does not happen to you...... How unfair! My ex had to pay back "welfare" monies I received yet I worked for the check that I got every month..... to me that's a double dip on the county's side if you ask me. I have a story to tell but not sure if this is the place to let it all go! GOOD LUCK and best wishes to you, hang in there

    No, that would be a reimbursement of state funds that you were paid out.

    It is the financial of responsibility of BOTH parents to support their child. Why would you believe that it is the responsibility of the taxpayers to pay for YOUR child?
