    Angry Help

    My question involves emancipation laws for the State of: Oklahoma
    My girlfreind and I had a child she is only fifteen and her mother is and alcholic starts frinking around 3pm until she passes out around 11pm and payton (our baby) is over there around that every day and my girlfreind and I agree that she shouldnt be there with her and we heard that being she had a child she can be legally emancipated.... i was wondering if that was true..... her mom has also yelled at her and kicked her out about a week ago but her and her dad came back home when she passed out.. its a long time before we are 18 so i was curious is there a way she can come live with me or even her grandmother or somone besides her mom

    No, it is not true.

    A minor who has had a child is NOT legally emancipated in any state. She are medically emancipated, meaning that she, with the help of her doctor, can make her own decisions about her medical care and that of her baby. But she not only is not legally emancipated, she has closed the door on ever getting legally emancipated since the baby makes it much less likely that she will be able to meet the financial qualifications, which are (deliberately) difficult for any teen to reach. In any case, an emancipated minor in Oklahoma can do only one thing that a non-emancipated minor cannot do, and that is sign a contract. Emancipation of a minor in Oklahoma does not give that minor the right to move out.

    You're in a fantasy world if you think she'd ever be allowed to live with you. Close the door on that thought right now, buddy - it ain't gonna happen. Not till you're both 18. You're lucky you're not in jail. IF her parents gives permission, it's possible for her to live with her grandmother, but ONLY if her parents give permission.

    cool it dude its not a fantasy world bud she can actually move in im looking in to it...band she only needs permission of one parent and if her mom is an alcholoc around the baby then she should be able to go to court and leave the home at the least

    And you think her dad is going to give her permission to live with you? The guy who got his daughter pregnant? You ARE dreaming. Stand by for a talk from Unca Jeffy.

    It will take a great deal more than her mother being an alcoholic for a court to take her out of the home.
