    Default Statute of Limitations on a Service Denied by Insurance

    My question involves collection proceedings in the State of: CA

    My case is unusual, at least I think it is.

    I was a dependent on my mother's insurance. I went to the dentist and had my teeth cleaned on 11-15-05. However, for whatever reason my mother's insurance denied the claim in 2007.

    I was unaware there were ever any issues, because it was my mother's insurance and unfortunately she never informed me there were any issues. I had received this service several times before and it was covered every other time.

    I was only made aware of the issue last year when I received a call from a debt collector saying that I owed a debt. I requested verification and they ignored me and sold the debt to another debt collection agency who is now calling me non-stop. My boyfriend has told them all communication needs to be done in writing, but they still continue to call.

    I am confused because the debt collectors have my name on the account, but my mother's social security number. The dentist group never tried to collect the debt from me, but instead sent all billing to my mother.

    Here is what I learned from the dental group:

    The service was rendered on: 11-15-05
    Insurance denied claim in: 2007
    The amount owed is: $504, however only $155 is for the service I received the other amount is for service my mother received.

    My question is when does the statute of limitations begin? I never made a payment on the account as it was always covered by my mother's insurance. The only thing I ever paid was a $10 co-pay at the time of service.

    Also, am I responsible for the debt? They have my mother's ss#, but my name, all other claims were made to her.

    If I am responsible how much am I responsible for? The whole $504 or only the $155 cost of the service I was given?

    were you a minor at the time of service?

    Regardless, you would not be liable for your mothers debt. Off the top of my head, I believe the statute of limitations in California is 4 years from default. That would put this debt out of being collectible if you nor your mother never made a payment. That does not mean they cannot still try to collect and even sue you and it can be reported on your credit report for about 7 1/2 years after first delinquency.
