    Default Will the EEOC Fine an Employer for Being Slow to Stop Sexual Harassment

    I wondering if the eeoc will fine an employer if it took 12 years to finally stop the harasser.

    The boss knew about it for 12 years and did nothing.

    I had to take sexual harasser to H.R. , after 12 years, and the sexual harassment stopped.

    I'm gonna call the eeoc on my employer.

    You're going to have a real hard time since you waited 12 YEARS before you reported this to HR. When was the last incident?

    I reported it to Hr last year.

    The last incident was last year when he had sex with a customer.

    Lots of employees did complain to the boss.........yet the boss did nothing. Everyone assumed that the boss would let HR know.

    The boss never let HR. know.

    A lot depends on the specific circumstances. A major problem that you'll have to overcome is why it took 12 years to file the complaint.
    Although is may not be proper, but a person having a relationship with a customer is not sexual harassment just because of the sexual nature.

    Specific circumstances.

    y question involves labor and employment law for the state of: I live Nevada.

    The story is long and rather complicated.

    In a nutshell a lot of employees complained , to the boss, that a certain individual was sexually harassing them.

    The boss did nothing. When too many employees at one property( the boss oversees operations at three properties) complained of sexual harassment from that certain individual , the boss would move that individual to another property.

    No one complained to H.R. because the boss knew and was moving the sexual harasser around. We all thought HR knew.

    What kind of legal trouble can the boss get into for not stopping the sexual harassment and allowing it to happen for so long? What will the EEOC do to the boss?

    There are a lot of problems with your situation. The supervisor attempted to correct the problem by moving the employee from the current position to another. The employer is under no obligation to terminate the individual regardless of the amount of complaints against him/her. Generally you have 180 days from the time of the harassment to file a claim with the EEOC; however, there are some conditions that allow the timefram to be explanded.

    If you file a claim outside of the timeframe for reporting the EEOC will likely decline to investigate the situation. If another instance occurs and you can file within guidelines, an investigation will commence and you may be able to show a repeated history of harassing behavior. Will the boss be in trouble?

    IMO most likely not if he can show the employee recieved some type of counseling (verbal, written, etc) and an attempt was made to stop the harassment, by switching positions for example. Again, the boss has no obligation to terminate the employee.
