    Default Answering the Door with a Holstered Handgun

    My question involves criminal law for the state of: NJ

    What if anything could I be charged with if I were to keep my gun in my shoulder hostler and answer the door? I live in an upper area surrounding a lake and there have been an increase of break-ins lately. I wouldn't be touching unless the person acted in a threatening manner.

    Also note I'm not too worried about the police knocking on the door while having my gun on my person because i have a notice that says I will not open to the door to police without a valid warrant. In addition I will only talk to police if i witnessed something on my terms and talking to them is the lowest of the lowest priority, so expect over a month response time.

    I'm sure im going to get the haters over the above so Ill make it clear, no record, no trouble with the law. So moving forward, is there any problems with answering the door with said hostler ?

    It's holster, not holster. As long as it is legal in NJ to have a handgun for home defense, you are okay. You are not technically brandishing it or displaying it in public. That's not to say someone might not take offense and report it, which may earn you a visit from the local constabulary. It would be better to only open the door a crack with the gun out of sight behind it, but such that you could bring it on target if needed.

    Yes, you have trouble with the law. I'm just saying that something in your life has skewed your view of police such that you view them all as the enemy. Your refusal to cooperate with them in a reasonable manner, even when your testimony might be the lynchpin in a case, makes that much obvious. Not all officers are bad ya know, they just have a job to do. How you interact with law enforcement, for whatever reason, is your choice. Just know that your failure to cooperate could make things worse for someone. Rather than looking at it as helping the police, which apparently would make your head explode, look at it as helping the victim of whatever you may have witnessed.

    One presumes you have the proper permit for your weapon? If so, I would concur with Free, you ought to be OK.

    Do you usually get visits from the police, such that you find your sign a necessity?

    NJ requires a permit in this situation. There's no exemption for open carry or being on your own property.
