    Default Disrespectful Wife

    My question involves a marriage in the state of:??

    Need advise:

    Facts :
    1) we are married overseas 15 years ago, we are not US Citizen nor perm residency holders. Perm residency is still away by few months.
    2) I work and own a house, plus few bank accounts and I bought an apartment overseas in joint ownership.
    3) We have two children 6 yr and 2 yr old sons.
    4) Wife used to work before the first child was born., now she is stay home mom, watches TV all the time, on the phone for hours, and on the internet for hours.

    Problems:
    1) Wife is always disrespectful to me since last couple of years we always have arguments on small/little things.
    2) She gets very angry at kids, beats them, forces them to eat, screams at them and gets very violent.
    3) A couple of times she threatened to commit suicide and also kill the kids. (although I know she said that in an angry mood), I told her I will call the cops if she says something like this again and she said she would tell them I caused this situation.
    4) She always gets very violent, very loud and screams a lot.

    Questions:
    1) I just want to end this all, I told her numerous times not to do such things in front of the kids since it affects them a lot.
    2) I would like to expel her out of my house, not give her any money since I created all this. I would also like to keep the kids. Even though she is a good mother and loves my kids a lot but she goes to extremity and I don’t like to create such scenes in front of the kids.
    3) What are the laws for filing a divorce? Do I have to file a divorce or can we just break the relationship? I know she will not want to do that because she cannot do anything by herself. I am very tired of her behaviour.

    what state you are in makes a lot of difference to the exact actions available but as general answers,

    disrespect is not controlled by law in this country. Each person has a right to not show respect to anybody else as they desire

    you cannot generally expel a spouse from the marital home. You would need to file a divorce action with the courts and ask for exclusive possession of the home pending he divorce

    if you want an actual divorce, yes, you must file for a divorce in the courts.

    as to who keeps the children; in most cases, barring some justification such as inability or abuse, both parents will be allowed time with the children. Who is granted actual physical custody will be determined by the court.

    If she abuses the children, you can call the police or child protective services and report the crime.

    state of NJ:

    Since I am not married in the USA do i still have to file for a divorce in the US? What will happen if I just expel her, we also have different last names on our passport. when I filed for her green card and dependent visa, i filed the marriage cert from the country of birth. Does that still make us married couple in the eyes of law?

    the US acknowledges marriages from most other countries of the world. Whether you want to use the US courts or not, she has the right to utilize the US courts to enforce the laws of this country and New Jersey. That means she could file for divorce, seek possession of the home and the children and child support and possibly even spousal maintenance from you.

    what if she continues to misbehave with kids and I call the cops, will she be prosecuted as a criminal and be deported? I might have some evidences of her misbehavior with kids. I have numerously told her not to misbehave with kids. Is there any other way out rather than having this matter get ugly?

    it sounds like it is already ugly. If she is actually abusing the children and you cannot stop it, you need to report it to the authorities, either CPS or the police. Depending on what has happened, yes, she might be prosecuted.

    It is extremely serious when a parent threatens to commit suicide and also kill their children. I urge you to persuade your wife to see a psychiatrist so that she can be evaluated. She may be mentally ill and need medication.
