    Default Student Loan Default Due to a Loved One's Illness

    My question involves collection proceedings in the State of: West virginia

    Hi i need soem help on some questions . My loved one has a sallie mae loans for around 18-19k. 5% interest and i think they are federal im not sure tho.

    We was making payemts.Until i got gravely ill from a botched wisdon tooth removal.

    I was damaged somehow and my health declined badly up until last year 3 months it was so bad i had to eat baby food. The injury was just discovered on or july of last year. I am in constant pain head jaws,bright lights blind me . Ringing in ears alot and constant necck pain. And i cant eat or digest food properly. I can barely eat fruits vegatables even at times they give me trouble. My loved ones loan was put off due my illness . Which i still suffer. But recently we got a mail we had not opene and noticd a lager past due amount.

    What are my options. And if i go route of letting them garnish her wages what can they take? is it monthly or weekly. She only get paid every 2 weeks at around 400-500 or 900 a month. Can they garnish that and take her tax check how does it work.

    I cant work as i cant eat propertly and am recieving poor medical care. We are in desperate trouble due to my illness. This is not a scheme or a trick not to pay. I am a devout christian man and am suffering . And never recived assistance of any kind in my life. I dont get any now. Tho i should be. Also i am weighing my options to the damage and suffering i got from the tmj and dentist. I just wnt to get better .But having headaches ears ringing and not be able eat properly has disabled me.

    Any advice or help be great sir.

    Have you applied for SSI/SSDI disability? That's one option you have.

    Hi sir no i havent. But its coming where im going to have to. I just dont want to .And have never had. Plus im been very very sick. So eve nif i would get it what use if im dead.

    But also i forgot to add. We have a car payment and insurance of 350 . Our other car engine rings went out. I needed to travel 200 miles to speical tmj doctor. And had no other means. So we had to get a used car. Got no help and couldnt rely on anyone.

    Top it off prior to trip someone stole our catylic convertor off. Its been very hard.

    Im just try find out whats the next best move. To avoid more pain an d suffering .And incase im gone she wont suffer.

    I'm sorry - truly, I am - but the loans aren't going to go away. Because Sallie Mae is considered to be federal, they can garnish up to 25% of her wages per paycheck. There may be State-specific exemptions, so if she does get paperwork she'll need to fill everything out and see how much disposable income she has - that will give an indication of how much they'll be able to take.

    I realize that you don't want to apply for benefits, but seriously if you are legitimately unable to work I don't see how you have any real option other than to do that.

    Thank you again for replys. Yes you are right about ssi. just when you ar so siuck and weak its hard. Plus the severe tmj i have from what i read and i may be wrong is hard to get.
    Plus i just am having trouble dealign fact i cant take care myself.


    But by disposable. What do you mean. she makes around 350-450 every 2 weeks.
    It varies after taxes.

    And she orwe have car payment and insruance of 350. So all we are left whole month is 350-400 i have to depend on parents now to to live them. I require speical food. Like organic fruits . so its not easy .
