    Default Was Not Charged with Shoplifting in Florida and I Received Civil Demand

    In March I was shopping at Marshall's with my husband; neither one of us have ever committed crime, he is 40 and I am 33. We went in the store and went our usual ways, he went to the mens side and I went to the womens. Shortly after, he called me over to the perfume/beauty product section and I asked me if I liked a few items (I thought he was going surprise me with a gift). I told him what I liked and then went on my way. We met up later with the items we found and then went to pay. We spent $150.00 and we were walking out of the store a man confronts my husband and tells him to come with him and instructs me to come as well. I had absolutely no idea what was going on and assumed there was some kind of mistake. We got back into the little room with the LP and Sheriff was also there. They asked my husband to empty his pockets, to my dismay my husband had taken several items. We have only been married for five months and nothing like this ever happened before. I was completely mortified. In total, he took $305.00 worth of merchandise. The LP then said that I was being charged as well for $100 of it because I pointed out some of the things I liked, that happened to be found on my husband??? I did not take anything and while I understood that I had to sign a no trespassing, I could not understand how I was responsible when I had no idea what he was doing nor did I take anything from the store. The sheriff said to LP was anything found on her and the LP said "no" and I was not charged with anything and he told the LP that my husband was responsible and he arrested him for felony shoplifting.I went home that night and then a few weeks after I received a civil demand for $200.00, I was not charged with shoplifting, do I pay?

    You're lucky you did not get a criminal charge for being an accomplice. Sounds like you are innocent, but LP, cops, prosecutor, etc have heard it too often from guilty people.

    Pay the Civil Demand (or better yet, make Hubby give you the money for it). If not paid, the store can send another letter and up the amount...and if still not paid, may take YOU to Civil Court. If that happens, that $200 can easily become $1000+......and can affect YOUR credit history.

    Most civil demand laws say you are liable for damages if you have _taken_ merchandise. There is no provision for being an accomplice. I suggest you check the civil demand law for your state before you pay.
