    Default FMLA Designation Notice from Eymployer Violation

    My question involves labor and employment law for the state of: south Carolina

    Ive been out on short term disablilty and revived a fmla letter from employer. Saying my leave started on feb 7 2011 and i"m eligible for 6weeks. I got the letter on mar 30 2011 after my 6weeks were over. I thought they had to notify you within 5 business days of leave starting???

    Why only 6 weeks? Had you already used 6 weeks in the FMLA year the way the employer counts it? What would you have done differently HAD you been notified? Would you have returned to work even though your doctor had not released you?
