    Default Domestic Battery and Assault with Bodily Injury

    My question involves criminal law for the state of: Indiana

    My mother and brothers boyfriend got into a verbal fighting match via text messages and phone calls. The girlfriend verbal threatened to do harm to my mother and used a social network site to call her name, and continue to threaten. That same evening while my mom was shopping in a store the girlfriend found her (which she threatened to do) assaulted my mom in the store. She was bumping my mother with her shoulder repeatedly, grabbed my mothers wrist and pulled the phone out of my mothers hand. My mom was trying to call the police b/c she asked the cashiers to do it they both refused. The girlfriend has her mom, dad, sister, 2 or 3 friends, a cousin and her young (under 10) son there. The cops did not arrest claiming is was domestic dispute. My mother has asked for police reports and no one can give her one. They tell her she needs to present it to the prosecutor, but the prosecutor has been leaving early and she is unable to do it until after the weekend. Meanwhile this girl had a restraining order put on my mom claiming that my mom is harassing and stalking her. When my mom tried to get a restraining order the judge has went home. Also, this girl continues to threaten my mom on the social network and has included numerous of her friends to do the same. The girl is also frequently visiting the place my dad works and other places my sisters and brothers go. She is from the next town about 20-30 miles away. I'd like to know what we can do about this to make sure it doesn't get lost b/c someone told my mom the cop that was there said he was not going to investigate? The store has video but the video does not show their faces so they said they can't use it. If the cops don't do anything where else can my mom go? this is a very small town. Thanks for any advice

    Mom should get a lawyer to attempt to defend her against the petition for the restraining order and to help her with her counter-petition, and to try to obtain any security video that the store may have of the incident. I have no idea who you mean by "they said they can't use it" - the police?

    Yes. The police told my mom they could not use the video b/c it does not show their faces, only "silhouettes" (police used that word), basically meaning, the security camera in the store was pointed at their backs. This all sounds so fishy to me, they should have arrested her at the scene but didn't b/c they said it was only a domestic dispute, even though my mom had marks on her wrist. And from what I understand, domestic is defined as being or have been married, living or have lived together or having a child in common. To me, that means boyfriend/girlfriend, husband/wife, mother/father. Could the fact that my brothers girlfriend is the mother of my moms grandchild be viewed as a "domestic" relationship by the state of Indiana? And I don't understand why they said it was only a dispute if she had marks on her? Thank you so much for your advice!

    And the store that this occured in is also not wanting to give my mom the tapes or let her see them. Doesn't she have a right to see the tapes?
