    Default Internet Harassment

    can a threat being typed in a private internet forum, with a clear TOS describing a trolling and joking environment, be taken out of context and used in a civil harassment case? Even if the harassed was never contacted directly? Isn't this kind of speech protected by the 1st amendment?

    Threats are rarely, if ever, protected by the 1st Amendment.

    And no amount of forum disclaimers will change that.

    A threat can be taken seriously and reported, and civil and/or criminal repercussions can result.
