    Default No Child Support Payments

My question involves child support in the State of: MD

My question involves a child custody case from the State of: MD

My 12-yr-old son's father is a mess. We've been split for almost 11 years, never married, son has his last noame and he is on the birth certificate. Child Support has been sporadic over the years, went MIA for about 18 months at one time. Have court ordered child support since Jan 2009 but no visitation agreement. I get payments about every 3 months (sometimes), yet I hear of trips that he takes, electronics that he buys, people he brings into his home to support. He works under the table for people, hasn't had a paycheck to garnish in 6 years, hasn't worked (this time around) in 6 months yet somehow rounded up money to go to the beach for spring break.

I'm tired of my husband and I working our butts off (he does sidejobs to make extra cash after he works his full time job) to make sure our kids are taking care of and the biological father takes no responsibility whatsoever.

Can I legally tell him he can't see our son until he gets his priorities straightened out?

P.S. it's not just the money - he's minimally involved. Picks up our son every other weekend, but doesn't even know the name of the school he's going to. Never calls his son to say hi, doesn't know any of his friends, never comes to a soccer game, etc.

You cannot use visitation as a blunt instrument like that but you can enroll your son in activities that the dad will either take him too or not be allowed to pick him up every other weekend. How much time does he spend with your (plural) son?

Also, I suggest you go to court and get his tax returns intercepted and threaten his driver's license be taken away. There are things you can do to force compliance.

He picks him up every other weekend (Fri-Sun) for the most part - when a sport season is in session, he picks him up after his Sat game. Never attends Teacher conferences, Back to school night, games, etc. The hard part is we live about an hour apart so he refuses to pick him up on Fri and bring him back on Sat for a game or other activity.

More than anything it just upsets me that we (my husband and I)work so hard and have to say no to so many things for my son when that extra help for the dad would be SO helpful - it's really not even that much, we survive without it. But why can't he support his child but can afford to take beach vacations?

Sounds like it is all working out with the weekends. not sure what else you can do except make sure he does what the state requires.

You need to stop asking why the father puts his life ahead of his son's life and accept that he does and treat him as a self-centered uninvolved parent. Almost zero chance that he will change and almost zero chance he will do anything that is not required by the court.

OP, you must understand that if Dad files to establish a court-ordered parenting plan, you likely will NOT be able to force him to take kiddo to events that are scheduled during his parenting time.
