My question involves child support in the State of: Washington
Support order filed in 2006 very vaguely states father will claim children on taxes. No years indicated, no waivers requested or signed, no statements saying mother will not claim children on taxes. In short, every qualifying question by the IRS allows mother to claim children.
Father is aware he needs form 8332 or similar statement to appear on support order. He does not have this so HE LIES on his taxes and says the children resided with him. Mother has all documentation (school, medical records, etc) proving she is custodial parent. There is no doubt the IRS will give mother the refund and allow her to claim children.
Can the state enforce this order? Can the state force the mother to ammend taxes when the IRS does not recognize the criteria has been met? Can the mother be held in contempt? Can she be forced to pay father all or half of her refund?
