    Default Mortgage Reported as Late Throughout Chapter 13 Bankruptcy - Is That Legal

    I filed a Chapter 13 in April 2007. My mortgage company agreed to the payments being made by the Trustee through the 13. I made payments on time each month to the trustee who in turn sent them to the mortgage company. They reported me 120 days late each and every month from April 2007 until October 2010 when they changed their reporting policy.

    I have disputed this many times with all 3 credit bureaus and have even written to the President of Wells Fargo bank (my mortgage company). My Ch 13 was completed February 2011 and I had to write letters to show my mortgage was current. I've managed to clean up most of my report except this which is very damaging to have my mortgage showing 120 days late each month for over 3 and one half years. Wells refuses to remove it. I sent my payment history to the bureaus even.

    At a loss on what to do. Can I take any action against Wells Fargo to get this fixed? Since this was their policy until October 2010, I'm sure there are many more in my same situation.

    They were reporting you as 120 days late. Were you 120 days late?

    Their policy was to report all the arrears that were included in the Chapter 13 as late - of course, each month, they remained late but were included in the Chapter 13. So, technically, they were late but included in the 13. Their policy in October 2010 changed from this reporting to no reporting.
