    Default What Constitutes Harrassment in the Workplace

    My question involves labor and employment law for the state of: Michigan

    I work at a prominent bank in town and after discussions with family I am choosing to stay home with our young children. I have given my employer many months of advanced notice to make adjustments for my departure and allowed me to train my replacement. I now feel like I am being pushed out with frequent and consistant verbal and written write ups over very minor issues (answering the phone incorrectly), discussions with my supervisor and HR that end in "just quit", and recently a "fake" termination where I was summoned to the HR directors office with my supervisor and told I was being let go - "Just kidding then we would have to pay you unemployment." (not very funny)

    What advise do you have as I would like to continue to work to build our savings yet it is far from enjoyable and I have three months more of this.

    Honestly, my advice would be to suck it up. It is not illegal harrassment to base the action on your decision to quit; that's not a protected class. In fact, I would opine that giving your employer "many months of advanced notice" was a mistake. Unless you are in very senior management, 2 weeks would have been plenty, and 4 weeks would have been enough no matter how high in management you were.

    Absolutely it was a mistake in hind site. HR had heard of my plans and requested a formal resignation date.

    My concern is not so much a legal resolution such as - (quick google search)
    "DANVILLE -- Calling it a "really bad joke", an apology is offered in Montour County Court. The Press Enterprise reports 25-year old Bryan Sokoloskie, of Elysburg, apologized yesterday and pled guilty to disorderly conduct. He was fired from the Danville State Hospital where he worked as a psychiatric aide. Sokoloskie wrote a fake termination letter to a co-worker in June as lawmakers debated the state budget situation.

    as being prepared for termination for a Mickey Mouse infraction and putting my family in an undue financial hardship because a couple people want to play with my unemployment.

    Well, if you think you've got grounds to take legal action by all means call a few lawyers, describe your situation and see what they say. If they offer to take your case on contingency, you're in business since that means they think you'll win enough for it to be worth their time for a percentage. If they want to be paid up front (or refuse to take the case, regardless of what grounds they offer for not taking it) guess what? You've got a loser.

    I always give employers the minimum time of notice when I leave ... just like they do when they terminate you..
