    Default Does the Virginia Beach JDR and DCSE Have Jurisdiction

    My question involves child support in the State of: Virginia Beach

    And yes... the family court Nazis in Virginia Beach think they are their own state.

    I have a consent order entered into when my kids turned 18 to assist with college. The kids are now 24 and 25. When they were 19 and 20, they became ineligible under the consent order as only one of the two attended college and it was on a part-time basis.

    The other kid quit school after one semester and moved to Florida. Now the kids are 24 and 25 and the DCSE and JD&R are trying to collect what they call "child support"... the problem is: my ex-wife and the two kids were not entitled as they were adults when we entered the consent agreement..

    In October, 2006 I was non-suited in Virginia by the DCSE due to a "lack of jurisdiction".

    Does the Virginia Beach JD&R [family court] have jurisdiction ? Does the DCSE have jurisdiction ? How can they suddenly gain jurisdiction after having relinquished it 5 years ago ?

    All of the JDR courts in Virginia are part of the Commonwealth court system. The fact that they are given names based on where they are physically located doesn't mean anything about what their jurisdiction is. If the matter is within the Commonwealth of Virginia they can hear it. In fact, cases are usually assigned based on the location of the DCSE case worker involved. If the consent order was issued in the Commonwealth, they probably do have jurisdiction. You'll have to answer it at least. Not being able to read the order, we can't tell you what will happened, but having been through this process myself, I suspect you are correct in not owing it but you'll have to at least answer the court filings to make that happen.

    I understand how the courts are named -- that part is in the Virginia Statutes...

    The JD&R Court originally had jurisdiction wyhen we entered the order in 2004. My kids were 17 and 18 at the time. the oldest graduated high school in 2004 and my ex-wife figured out a way to get me to sign a new order to pay for their college. This happened in 2004. 2 years later, in October 2006, the question came up in court that they were not attending college "full-time" as required in fact... one of the kids didn't even attend at all...

    In October, 2006, the DCSE summonsed me to Virginia [I live in Idaho] and non-suited me 5 minutes into the hearing. The DCSE attorney gave the Judge "lack of jurisdiction" as the reason for the non-suit.

    my question is: How can the J&DR & DCSE have jurisdiction over a consent order when:

    1) there are no children covered under the order [they are 24 and 25 now]
    2) the DCSE has non-suited me in front of the same judge 5 years ago claiming they had a "lack of jurisdiction"
    3) the order expired naturally when the children turned 22 in 2008 and 2009 respectively

    My question is: "can they really be doing this ?"
