    Default How Do I Get Out of a Chapter 13 Pickle

    My question involves bankruptcy in the state of: Wisconsin

    We are in month 34 of a 36 month plan, payments were all on time. My wife and I rent an apartment and were told by a lender that we could get a mortgage even before discharge. We qualified for the loan, signed an offer to purchase, and wrote an earnest money check. Then we told our lawyer, who hit the roof! “BK Court can dismiss, you’re committing fraud, ALL disposable income goes to the court, the court should have had the earnest money. YOU CAN’T DO THIS!”

    We’re in contract to buy. Now what do we do?

    What does your lawyer suggest? Your options are to try to get retroactive permission to do what you did but barring that you try to talk to the seller about getting out of the contract based on the situation.
