    Default Extended Summer Visitation for Child Under Three

    My question involves a child custody case from the State of: Texas
    I am the non-custodial parent in a custody case the was settled in November , 2010. The custodial parent states that the extended summer visitation does not begin until our child turns 5. I read the final orders to say the visitation is effective immediately. What is your experience with this (our child will be two in August)? I feel I was mislead in court if this is true...or I would not have agreed to the settlement.

    What do your orders actually say?

    While I believe you might actually be correct here, you must think of what's best for the child. Being away from the custodial parent for weeks at a time is not generally recommended for a 2 year old in these circumstances.

    That will depend on a lot of factors, including access to the custodial parent during the visit. If we're talking two weeks with dad in the same county, where mom can phone and visit the child on a regular basis throughout the extended visit, it should be quite manageable. I'll note also that some courts take a "Kids can survive anything" attitude, and aren't much concerned with what the psychologists have to say....
