Default Landlord Doesn't Understand About Black Mold

My question involves landlord-tenant law in the State of: Texas

My landlord keeps putting me off about fixing a black mold problem. I still owe 300 for the security deposit and all they say is well.... we will have someone look at it in a week or so - but do you have the 300?.....

I tell them that if this is black mold and my kids are here this contract is off. Do you know how bad black mold is???

She says well, how about the 300.....

What are the rights of tenants living with black mold in Texas?

Isnt it the landlords right to have it all fixed and pay if I have to move out during the clean up?

Most mold is "black", and most "black mold" is simply mildew. Have you had a test performed to determine if this is a toxic mold? If not, what are you waiting for?

We can't see the mold from here, nor do we have any information about where it is or why it's forming. What are we talking about - a leaky basement with mold on the walls? A drip under a sink creating mold in a cabinet? Something else?

Sorry, I just moved in April 1st, 2011..... I started to do my kids laundry when I noticed the water was backing up and coming back out where the drainage is going. Landlord finally had plumber come out where he had to cut a large hole in the wall to fix plumbing. Inside the wall is where it was noticed. I have a pic, but don't know how to upload it.
Also, plumber said he was there before (previous tenants). He said problem happened with them too (which means, this is not a new problem).

    EDIT:

    I uploaded pic -
