    Default Theft, 6th Degree

    My question involves criminal law for the state of: Hawaii. My daughter who is only 15 was caught stealing 16$ worth of merchandise. What could happen to her? IS it alright if the owner of the store imprisoned her, while the owner told her to call me? Behing a closed door in the back of the store? Whats the best and worst case senario? Please, I need help, thank you

    Yes, it is perfectly acceptable for the store to restrain her pending police arrival or, in this case, your arrival. Do you believe they had to just let her go?

    If there was no police involvement, she will receive a civil demand. If the police were called, she will receive a civil demand and will have to go to court.

    Thank you for your help. What exactly is a civil demand, and how does this effect her future?

    A civil demand is a demand from the retailer to be made whole from the theft. Typically, this is a multiple of the stolen goods and includes whether or not the goods could be resold.

    In this case, I would plan on around $150.

    As far as effecting her future, if there were no police involved, there will be no criminal record.
