My question involves criminal law for the state of: Texas
My 14 year old daughter attended a party last night, that we believed (my daughter included), parents would be supervising. She called me a little while after we had dropped her off, to come pick her up because some people had brought alcohol to the party, and she didn't want to be around it. I told her to go wait outside, and that I would be there soon. As my husband and I pull up to the home, we see that the police have arrived; one of the neighbors had reported it. My daughter was inside the house, and the police were issuing her a citation for Minor in Possession. My daughter had been outside of the party, and was directed by the police to go in the home, she had not been drinking, and the officer refused to giver her a breath or sobriety test, which we requested. She is an AB honor roll student, cheerleader, and has never been in any kind of trouble. I don't know how to proceed, or if we even need a lawyer.
Any assistance is greatly appreciated.
