    Default Minor Misdemeanor (Previously) Now a 4th Degree Misdemeanor

    My question involves criminal records for the state of: Ohio

    I have a minor misdemeanor already for possession of marijuana. I have never had this expunged. I didn't think I needed to as I knew it created no criminal record. I payed my fine for the incident and went on. (I never received a license suspension for the incident, which I thought was mandatory)

    2.5 years later now and I received a 4th degree misdemeanor for paraphernalia possession.

    Will my MM be seen by the courts? If so, will it effect this new charge substantially? Example: Inability to have these expunged?

    According to this you are still a "first time" offender as an MM is not countable as a previous conviction.
