    Default Accused of Breaking Into an Email Account, But Was Given the Password

    My question involves criminal law for the state of: Illinois/MN


    This guy I know gave me his password for his email in the past and now he is saying he did not and says he is pressing charges on me for using it. He is lying about not giving it to me. As far as that goes he lets other people go into his email, so how could even know which person went into Yahoo? This is why I believe he is doing it; He is angry because I reject his advances. He is angry because I would not marry him to get a green card and is looking at deportation now soon. He also thinks I posted some junk online about him, which I did but have since removed it long ago. I realized it was childish. Now someone else is posting stuff about him and he thinks it is me (this time it is not). I have emails from him threatening to post my name all over if I do not remove his name, which I cannot do because I did not put the stuff up. In fact, he is posting my full name on blogs and saying I did derogatory things when I did not. He is saying he will keep posting my name until the stuff about him is removed. I cannot remove it because I did not put it up. I believe he is pressing charges because of all the above goings on just to get revenge for something I did not do. Will these emails I have showing his threats and the blog/forum postings from him show how malicious he is and he could really be lying about giving me the password? As far as the password permission it is his word against mine, only I am the one telling the truth. I don't know what to do. I am disabled with PTSD and cannot deal with this stress of thinking the feds are going to show up at my door. What can I do to get him to stop? I would not have a dime to defend myself. He is in Illinois, I am in MN.

    Technically, private citizens do not press charges. They ask the D.A. or grand jury to charge someone with a crime.

    Have you actually received notice from a court saying you are being charged with a crime?

    If so, what is the state and statute number?

    If you have not received such a notice, I suggest forgetting about the "press charges" part of this, though you may want to watch the YouTube video Don't Talk to Police.

    If you haven't been going into his email, then you haven't been going into his email. If you have been going into his email there will be a record of access from whatever IP you used when you accessed his email, and depending upon where you were at the time of access it might be possible to trace the access back to you. If Yahoo! tracks MAC addresses, it may also be possible to show that you accessed the email account from a specific computer or device.

    If he reports the incident to the police and they find it serious enough to warrant investigation, they may try to contact you for your side of events or they may seek IP information from the email host to see if there are any unusual or suspicious patterns of access and try to trace them back to you. Again, if you did nothing wrong then you did nothing wrong.

    I suggest not having anything more to do with this person and, whether or not he gave you his passwords, making sure that you resist any temptation to try or use them and, similarly, to resist any temptation you might have to post anything about him online.
