    Default Charges of Theft and Receiving Stolen Property

    My question involves criminal law for the state of: Ohio

    I was charged with 1st degree misdemeanor for shoplifting around $250.00 merchandise and having $343.00 worth of stolen merchandise on me and was also charged for that which is the receiving stolen property.
    I pleaded not guilty and am planning on speaking to a public defender.
    I also have a prior misdemeanor for underage consumption which was over a year ago.

    What is the probability of jail time? Would getting the underage consumption expunged from my record help if they already mentioned/saw it in court today?

    The best person to estimate what you might be able to achieve through a plea bargain and what sentence you might receive is a local lawyer. The disposition of offenses of this sort can vary significantly depending on your record and local court and prosecutor policies.

    You're not going to hide your underage consumption record from the prosecutor, probation department or judge at this point in the game.
