    Default Children's Division Fabricated Evidence and Deprive Parents of Civil Rights

    My question involves civil rights in the State of: MO

    We have a case where the state Children's Division lied to create evidence against us in order to find an allegation accurate. We recorded all interviews so we can prove they fabricated evidence but now we have a quandary. We aren't flush with cash so here is the questions...

    1. Can we file an injunction in federal court to cease all state court activity until after an appeal process is complete.

    2. Can we file this appeal on our own without an attorney?

    1. I very much doubt it, but you haven't shared either the factual or procedural status of your case. Discuss your options with your lawyer.

    2. I would not expect this motion to succeed even if you had a lawyer. I don't know what, if any, federal issues exist in your case or whether your case is positioned for you to seek relief through the federal courts, and the type of relief you want is rarely granted even when there's good representation, a good record and a proper basis for federal review. But as I said, you haven't shared the facts or procedural history - if you want your situation analyzed you need to consult a lawyer with access to all of the relevant facts and procedural history.
