    Default Caught Shoplifting While Visiting Another State

    My question involves criminal law for the state of: PA

    As I was leaving Sears today, the Loss Prevention guy followed me into the parking lot and stopped me. I had taken a couple items from the store (in the fitting room). I refused to stop and walked away. I think the guy got my license plate number. I am from out of state (I live 7 hours away). I have no prior record. Will the cops be paying me a visit? Do I have to stop for the security guard?

    well, it's obvious you don't have to stop for the LP as you didn't. The LP most likely had a right to stop you if you failed to stop for him though. Sears policy may be one of not using any force so what happened happened.

    so, are the police going to be paying you a visit? That is unkown. Sears can report the theft to the police who can then turn it over to their DA who can seek a warrant for your arrest. If you are out of state, the locals (to Sears) do not have any authority in your state so, the arrest warrant will sit there, waiting for you to have contact with the police who, if the warrant pops up when they look at your record, will arrest you. You will then get to sit in jail to wait to see if PA will extradite you. I believe they have 30 days to make the decision during which time, you cannot bail out of jail.

    so, basically there is no way to know what will happen, only what could happen.
