    Default Hired to a New Company, then Denied the Job

    My question involves employment and labor law for the state of: Nebraska.

    I was recently hired on for a full-time position. I went in, signed all the paperwork, my wage agreement, W-4, company policies, etc. I gave my current employer proper notice of resignation. I was told that I would start as early as the next Monday, but that they would let me know. A week and a half after the initial start date, they called me to tell me that they had found someone else that they wanted to hire and that I did not have a job. Is there anything I can do about this since I quit my other job, signed all the paperwork, etc? I am now out of a job and suffering as I have a mortgage, a child, and many other expenses. Please help!

    I suggest taking it to a local labor attorney. It sounds from what you posted that the company created at the very least an implied contract by having you fill out the paperwork and a wage agreement.

    Under Nebraska law it appears you may have a case:

    In Goff-Hamel, an employee had resigned her employment in order to accept another offer of at-will employment, but before she began her new job, she was told not to report to work. We concluded that the unfulfilled promise of at-will employment was sufficient to support an action for promissory estoppel.
    Do consult a lawyer, but don't let up on your job search.

    i would try and get your old job back. If you left in a responsible manner they may be happy to have you return.

    While OP is certainly free to try, why on earth would they re-hire OP? OP was obviously looking for another job while working there, which tends to imply OP was not happy with some aspect of the job. Given that, the former employer would be reasonable to assume that OP would only be staying long enough to find another job again. If they have already located a replacement, or are far into the process, they would have to start all over again when OP leaves the next time.

    Yes, at least 2-3 job contacts a week .... excellent advice .. the OP still has the duty to mitigate
