    Thumbs down DHS Steals Child Support

    My question involves child support in the State of: Michigan

    Last year the state took 9 thousand dollars [the full sum paid] of child support paid. This was "accepted on behalf of" by friends of the court [DHS]. This wasn't even brought to my attention until around tax time when a simple letter with the dollar amount shown was mailed to my house.

    I'm informed that it is something that was included with Cash assistance, but cash assistance has not been received since 2004, furthermore, we've been continuously denied benefits every time we apply. [Cmon now, you cant have both >] FURTHERMORE furthermore, no where near 9 thousand was received in total! so its not like they are just taking what they gave. Could you imagine lending someone 50 bucks and them taking your next paycheck?

    Additional details I can provide, can someone please help me find my options?

    A letter was written to the state rep. and the reply didn't have anything to do with the money taken, it was a suggestion that we pursue legal action for the remaining money. which seems pointless if they are just going to take it anyway....

    PLEASE Please please help. this makes me sick to my stomach! I'm still looking online for more answers because I will not just let this outright disgusting theft go if theres something I can do about it!

    How long had you been in arrears?

    How much of that amount was interest?

    What exactly are you wanting to accomplish?

    If you collect public assistance and receive child support, the state will recoup part or all of the public assistance it pays from the child support. If you're describing payments toward an arrearage accrued during a time that the parent who was to receive child support was receiving public assistance, the state will attempt to recoup its money from payments toward the arrearage.

    Thank you for the replies, I'll try to find the exact amount owed, but I'm sure it wasn't anywhere near what was taken.

    As I stated in my post, I feel that more than what was owed was taken and I'm trying to find a way to collect at least the difference. I've read that the state doesn't tend to give money back to you once they get a hold of it even when you prove they aren't supposed to have it but thats something I can't accept....

    When the money was taken there was no statement about it going toward a debt, it more or less just said that they took it [paraphrasing of course].

    Please answer the questions

    You obviously know that the money was taken because of a child support debt - so unless we know more details, there's really not much else we can do here.
