    Default Appealing a Conviction After Probation Violation, Failure to Appear

    My question involves criminal law for the state of: indiana

    i was arrested for an owi, leaving a scene of accident resulting in property damage, and minor consumption of an alcoholic beverage. the night of the arrest 2008, i got jumped at a party and told to leave, as i was leaving the assailants continued to harrass me by throwing rocks at my car, which led to a cinder block coming at my windshield, i instinctively put my car and reverse, hitting the car behind me, and the cinder block still hit the hood of my car. these people potentially could of killed me if i stayed and swapped insurance. I then drove to a gas station a few miles away to regain what happened. a police officer recognized my car due to the police call from the assailantsing i hit their car, and i was picked up

    i served 11 days before being bonded

    not being able to hire an attorney due to financial situationa public defender told me to plead guilty. i served 80 days in workrelease then violated through work release day 81 of 90for a .02 bac and served 6 days in jail and then released

    then placed on probation. passing 14 drug test throughout the time of being on probation. i also completed a drug and alcohol intensive outpatient program succesfuly.

    after going to court for the violation i served 5 months on a scram bracelet
    which and when i was not drinking, i was sober 5 months why would i drink one night? no lawyer would take my case and i was told scram was impossible to beat.

    i ran from the sentencing of this violation and they continued with my hearing without me present and after calling the clerk to try and clear my warrant it is understood i was sentence to the full term of the case i was convicted for in 2008 that i should of pled not guilty to in the first place.

    i am in a pickel i am young and trying to start a new life. i want this stuff behind me but i don't want to serve a sentence i do not deserve. i have done alot for this case and forked over 6 grand in legal fees WITHOUT a lawyer. can someone please help guide me in getting my warrant cleared or how i should handle an appeal to the original crimes?

    The odds of a court allowing you to try to set aside your guilty plea some three years after you confessed under oath to the crime of drunk driving, and after your having violated probation and absconded, are pretty much zero. Your deadline for filing an appeal expired a long time ago.
