    Default Statute of Limitations for Battery

    My question involves injury or loss that occurred in the state of: pennsylvania
    In May of 2007 my boyfriend at the time beat me up and put me in the hospital, i had no medical insurance at that time. I thought i did and thought i took care of this bill years ago only found out it wasnt taken care of because they decreased my credit limit on a credit card so i did my annualtaxreport and the report has this 800.00 bill in collections. I have photos from the hospital and a police report from the night of the incident, as well as i recieved a pfa on him that next day. I was wondering what i can do if anything it happened in 2007 so im worried about the statue of limitations can i do anything in civil court?

    The statue of limitations has expired on the incident.

    Injury to Person 2 yrs. Tit. 42§5524(1)

    so i cant sue him through civil court?

    No. You had two years from the time of the incident because that is when you knew that an assault had occurred against you. Nothing in your post indicates any reason why the statute would be tolled, or suspended. Examples of that would be not having sufficient knowledge of the offense, the other person being out of the country for an extended period of time which would prevent proper service, etc.

    Was the incident reported to police? PA has an excellent Victim Compensation Program, but it's only available to those who work with authorities to hold offenders accountable for their actions.
