    Default Social Security and Workers Comp in California

    What are the rules of paying back Social Security from Workers comp settlement if your illness is a progressing disease and you will need to stay on Social Security. The disease process is degenerative over time.

    Generally speaking, when they have a basis to claim a portion of the settlement, they take a lump sum from the settlement.

    It depends also on your age and the type of settlement. IF this will be a life long debilitating disease there may also be what is called a Medicare Set Aside. Contact your local Information & Assistance office if you are not represented for assistance.
