    Default How Do You Enforce an Income Deduction Order

    My question involves child support in the State of: Florida

    My children's father moved to another county. He now has a new job. The child support office said that they have been sending the Income Deduction Order to his new job, but they are not complying. Can his new employer get in trouble for that? The CS office said there's nothing they can do but keep sending the employer letters. It's really up to the father to get the child support paid. But if it's a court order, isn't his employer supposed to comply?

    I believe he is working for his family and they are not complying with the order because he is family.

    What can I do? Please help. I'm behind 2 months in my rent and bills are starting to accumulate.

    Depending upon when the new employer was notified of the garnishment order, assuming the documents served upon them were in proper order, it can sometimes take a while for the information to be updated in their systems or with a third party payroll company. How much time has passed since they received the first letter?

    If the child support agency wanted to be a bit more aggressive they could initiate contempt proceedings against the employer; but apparently the delays at issue don't yet trigger that type of action under their policies.

    When you spoke with the father, did he indicate that deductions are being taken from his paycheck, or is he receiving the full paycheck without deductions? If the former, it may be that HR or possibly a third party payroll company is being a bit slow about forwarding the money to the state.

    Shame is effective if it is a large company or publicly held. Send a copy of the order to the board of directors and CEO, etc. Also if a foreign company, get your congressman or state department involved as their are provisions for collecting child support. You can also move to have assets of his seized in the US or move to have a contempt hearing in the states which he will have to attend or pay to have himself represented. The result could be an arrest warrant or the cancellation of passport, etc.
