    Default Writ of Execution

My question involves court procedures for the state of: Maine
I purchased a house 12 years ago. there was a writ on it from the previous owner. In order for the loan to go through it was paid from my loan. I am refinancing now and there seems to be no record of the writ being paid. Who would be responciable for this? wouldent it be the entity that did the closing or the post closing?

    Default Re: Writ of Execution

I expect that the entity that filed the writ was responsible to file documentation that it had been satisfied and, depending upon the timing involved, the title company may have been responsible to ensure that the document was filed. The writ was filed by what entity (I don't need the name; just the type - a state or local tax agency, a private judgment holder, a mortgagee, etc.) Have you contacted that entity to see if they'll cooperate with executing the documentation you now need to lift the cloud?
