    Unhappy LandLord Threatening and Vendetta

    Here is the issue on the plate, My friend is being evicted from his apartment because he is my friend.

    In the latter end of June the land lady and her manager stopped by and I was at my friends apartment visiting. She has never liked me and has made that clear. she said that she does not like me being there but doesnt want to come across as saying that she cant tell me who i cant be firends with and that i cant see my friends, but that she did not like me being around there. I have never done anything threatening nor anything bad or problematic to any of the tenants there. She said that she doesnt want me staying there because I would have to be put on the lease and my friend would be charged more in rent a month and she made it clear also that she owuld never put me on the rent. I told her that i was not staying there, that i live just a few blocks away. She and her manager left and everything was fine utnil the 9th of July. My friend received a package left on his door of a NOTICE TO PAY AND NOTICE TERMINATING TENANCY. My friend hasnever had any problems there and in this notice that was left to him it says and names me on the lease as a person staying there and is demanding THREE HUNDRED AND TWENTY DOLLARS for the month of June. Assuming that i lived there during this time. I did not. and i stayed maybe three or four night there during that month. I leave around midnight because we both keep late hours. The times that i have stayed the night there was because of having to get up in the morning and take my friend to his medical appointments. he is a diabetic and has difficulty getting around.

    Now in this notice it even says that even if the money is paid that my friend is still being told that he has to leave and his tenancy is terminated on midnight of july 31, 2006. Now i get the feeling that this isnt legal and that it is the land lords way of getting back at me through my friend by making this up and trying to get him evicted. Is there anything that we can say or do. I dont want my friend to get evicted because of his being my friend and the land lord not liking me. I have no criminal history and am a good person. its my family name that she doesnt like. there was no warning or other notice given. just the three days to quit and vacate or pay thingy. is there anything that we can do. ?

    State tenant and landlord laws vary. Which state did this occur in? And did the landlord give your friend a written contract?, If so does it read anything about visitors?

    This occured in the state of washington and the only thing mentioned in person was that a person or guest was not allowed to stay for longer than 7 days before they would have to be put on the lease and sign the lease as well and they would have to start paying for the rent there. Now in the lease agreement which has now became a month to month basis the guests and the only part of that mentioned in there states:

    Resident shall notify landlord or his agent for approval of any additional person residing in residents dwellinf after the 2nd day. failing proper notification and approval from the land lord, resident agrees to pay TEN DOLLARS per day for each additional person residing on the premises after the 2nd day.

    That is the only thing that is put in there and they are assuming that i lived there for the entire month of june and on into july. Now this idont understand becase they have no proof of that and i did not stay there at all. Like i said i live jsut a few blocks away and leave often at night.

    Each one explains your rights. Another idea is to retain a tenant attorney if you think it turns to a bigger battle.

    The only way I can see why the landlord wanting the tenant to pay more for a visitor is if the landlord pays the natural gas, water and electric bill.

    Here is an update as of right now. The land lord and hte manager ended the eviction notice and said that he could stay after my friend told them and explained that i was not staying there, however they are still not wanting me there and are holding that eviction thing over his head saying that if i come around that they will either re do it and go through with it this time or something else.... what is the recourse that i can do for this. i like hanging out with my friend and he likes my company...

    The landlord cannot unilaterally change the lease, that is why you have a written leasing contract. Generally a landlord can not dictate to a tenant who he/she can have as a guest, though guests can be regulated IAW the lease. I don't believe that the landlord can charge your friend extra rent for a guest who has stayed too long, but your friend can be evicted, or given the choice of eviction or pay. It also sounds like there is insufficient notice if your friend were a month-to-month tenant.

    I don' think that the landlord can legally keep you away, but at minimum, the landlord can refuse to renew at the end of the lease. It would seem for practical purposes, your friend must choose between you or his apartment, though you could spend time together at your apartment or elsewhere.
