My question involves bankruptcy in the state of: Minnesota
We lost our home in a forclosure 2 1/2 years ago. Since we had a second mortgage we were advised to file a bancruptcy to avoid our checks being garnisheed at a later date because of the
2nd mortgage. We have been paying on a Chapter 13 for over a year now. As of today the only payments that have been made have been to our cars, IRS back taxes, the Attorney, and the Trustee. One of our cars is paid off. We have approx. $13,000. in Credit cards that filed but have yet to be paid on.
The mortgage company has not even filed yet. I cannot get straight answers from our attorney about this. He said they have a time limit to file but cannot seem to tell me when that is..... I know that our credit union would work with us on the other car payment.
My questions are...if we stop the chapter 13 can the credit card companies garnishee our wages? How long does the mortgage company have to file a claim?
We filed on 02/26/2010 and are set for 5 years at $1180.00 a month. When I add up the amounts owed it just seems to me that we are paying so much and struggling every month for nothing. The main reason we filed was so the mortgage company would not go after us.
Any information would help. Our attorney doesn't seem to want to help us. What should I be asking him to do for us? With the gas prices so much higher now we are really struggling to make ends meet each month.
