My question involves emancipation laws for the State of: New Jersey
For the past 10 years I have been paying the child support set by the court, which is paid to her directly, she waived probation. so 2 years ago when my, then 18 year old, moved in with me, I cut child support in half being I would now have one child (18) living with me and she would have one child (15) living with her. Two weeks ago he moved back with her and she now is taking me back to court for child support evaluation, I assume for the 20 year old too. But he has only been living with her for 2 weeks and its 9 months since in school, he is attending college but less then 12 credits a semester, I tried to push him into taking more credits so I could keep him on my medical insurance but he has yet to comply. so my question is, what do I do in response to this child support request, will the judge just emancipate him due to his lack of credits during the past 9 months? Or will I have to pay anyway? Thank you
