    Exclamation Termination of Biological Fathers Rights

    My question involves adoption law for the State of: KANSAS

    My daughter will be 2 in July. Her biological dad signed the birth certificate. But he has never had any part in her life, and has never paid any child support. I want nothing from him. I met my fiance when my daughter was born and he has been with her from day one. She calls him daddy and he has always called her his daughter. We are getting married in a couple weeks and my fiance wants to adopt her and have her last name changed to his.

    The biological father is a registered sex offender. And he is currently on the run for a parole violation as well as jumping bail, and has warrents for his arrest pertaing to drug charges. When he is finally caught i'm sure he'll get at least a couple years in prison. I have recently contacted him and he refuses to sign over his rights. How do we go about getting his rights terminated and my fiance adopting my daughter.

    You will need an attorney. Adoption is never a DIY project. It isn't even possible until after you are married.

    I know that we have to be married. But i have been told that before they will grant adoption and termination of his rights that we have to be married for a year. is that true??

    and also with the 'bio' being on the run will that have any effect on how quickly we can get all this official?? because its obvious he is NOT fit to be a father. I also forgot to mention that he has 4 children total(including my daughter) that he has nothing to do with. one has had his rights terminated. will this effect the decision at all?

    He's fit until a court says otherwise.

    (And you'd likely be astonished at how low the standard of "fit" parenting actually is).

    Yes, most jurisdictions prefer that you've been married for a year or so to show stability.
