    Default Trial De Novo Court Notices in Los Angeles County

    My question involves traffic court in the State of: California

    I went through the TBWD and was found guilty. I received my guilty verdict in the mail on March 23, 2011. I sent a trial de novo request to court by certified/registered mail on March 29, 2011. My return receipt was sent back on March 30, 2011.

    Now, I am not sure what the next steps are. When I go to the website to check my violation online i see the following status:

    iolation Date: 10/27/2010
    Initial Due Date: 12/15/2010
    Case Status: Court
    Disposition: 12/08/2010
    Last Action: Court trial
    Last Action/
    New Appearance Date: 03/22/2011 in 067

    This citation is not eligible for any online transaction.

    Will a new court date be mailed to me via snail mail? Or will I be able to check online and request a court date online?


    If they do mail it, when should I expect. I am getting a little paranoid since I have not received it yet.

    Thank you so much in advance. And sorry for the very newbie question, I tried searching everywhere and did not get the answer I was looking for.

    Your TDN date will be set by the clerk and you will be notified by mail. You will not have the option of selecting a date.

    Hard to say... But if its been a week since your request was delivered to the court, it shouldn't be too long.

    Nah, you sent your request certified and you have confirmation that it was delivered, so you should be OK!

    I still have not received a letter in the mail... should I go to the courthouse to find out what date they assigned me. The only reason I am a little panicky is because I am out of town all next week.

    And am hoping the court date isn't too soon. I recall reading its around 45 days after you get your letter.

    Also, when I check my status on the website it shows that it is case closed. If they have received my trial de novo request, will they update the statuses online?

    Is it safe to assume that the court has your current mailing address? (Usually, the address that was written on your citation).

    Yes, that would be your best bet.

    Typically, (from CRC 4.210(b)(7)) "the clerk must set a trial date within 45 calendar days of receipt of the defendant’s written request for a new trial". Though those time limits can be changed by the court for any reason (see 4.210(c)). This is "THE" busiest courthouse in the county so it is not likely that the new trial date will fall under the 40 to 45 day limit, but you never know.

    Thanks so much! You have been so helpful. They initially did not have my correct address do I had to go to the courthouse because I never received the trial by written declaration paperwork.

    It had been updated but maybe something is wrong. I'll have to go AGAIN this week which will be my 3rd visit. I had a 2nd visit because ther improperly processed my tbwd and it showed online that I had not turned it in. Even though I had.

    This whole process has been a pain. Next time I should just pay the fine and ask for traffic school. Or just not get pulled over.
