My question involves criminal law for the state of: Michigan.
I lived in Michigan for about 8 months while I was 19. While sharing an apt with roommates, two of them got into an altercation and someone in the house slammed a door. The police were already across the street because we lived in a bad part of town (Jackson, Mi). Anyway, they knocked on the door and asked what was going on. I answered the door and said my roommates had a verbal altercation but everything was fine. They asked if they could enter the house and I advised them that they did NOT have permission to enter the home. The police stated that if I didn't let them enter that they were going to arrest me. When I asked what I would be arrested for, they pushed past me into the home.
They interviewed my roommates and confirmed that nothing bad was happening and warned them about arguing and creating a disturbance. One of the officers (there were 4) noticed that there was an open beer on the coffee table. My open beer. He breathalyzed me to confirm it was mine, even though I wasn't drunk. I blew a .03 and he wrote me a ticket. Well, the next week, I received word from home (California) that my grandmother was very ill. I left the same day I heard and moved back home to be with my family.
I honest to god forgot all about the damn ticket when I moved home, especially with everything that was going on with my grandmother's illness at the time.
Anyways, to get to the point, I received a letter from the warrant enforcement division but it was not addressed to me, it was a name that starts with the same letter as my name, but it is not my name or even close to it.
My questions are:
1. If I ignore the letters I am receiving, can they arrest me in CA for not paying a MI fine?
2. If I ignore the letters, will it drop off after 7 years? It has already been 5 years. Yeah. 5 years!
3. Is there a way for me to get out of the ticket since it was not issued to me?
4. Is there a way for me to fight the ticket since the police forced their way into my house? It all seemed so shady that I couldn't believe it!
I know that as a minor I should not have been drinking, however I wasn't drunk or in public, I was drinking in a private residence and just so happened to get caught because my roommates wanted to fight over whose turn it was to do the dishes.... any suggestions are wildly helpful.
