My question involves landlord-tenant law in the State of: Virginia
I've rented my 3rd floor condo since January 2007. For the last 2 years, my downstairs neighbor has made NUMEROUS complaints to the condo association about me washing clothes, taking showers and running my dishwasher. All of her allegations are unfounded and without proof. I am usually in the bed between 9 and 10pm because I get up at 4:30 am to drive over 45 miles to work. Monday, my landlord called me and said she was received a letter from the condo association threating to impose a fine for "noise violation". I wasn't aware that taking showers was a violation of "noise" however, I'm afraid I may be forced to move because the condo association is just taking her word for it. Can I take her to court for harrassment? Do I have any legal recourse? No other neighbors are complaining and my lease does not end until January. I have a high school aged son who I don't want to relocate. What should I do? I don't think there is any noise, I think she is prejudice against me and wants me to move.
