    Default Emancipation In Texas

    My question involves emancipation laws for the State of: Texas

    I need to know how to get emancipated as soon as possible. I am 16 about a month shy of 17. I have a job (AMC) and two available places to stay. (one is a friends house whose parents i have to meet and will charge 25-50 a month the other is free with no strings attached.) I am planning on taking up another job soon and I also can get to qwork through mass transit. I am tired of the verbal abuse and i do understand it is financially hard to be on my own but why not act now when i can empathize a glimpse of it? Im as prepared as I can be. I am also going to join the military at 18 if college isnt an option. Please post and help asap. Thanks for your time guys.

    You have no cause for emancipation. Emancipation is for recognition of those who are living independently. It's not a procedure to get you out from under parental slavery. Living with friends will not qualify you for that status. If trully abused, call 1 800 4 A CHILD. otherwise you'll have to deal with your oppressive parents.

    ok but my dad has told me that i can leave if i can find a place to live and i can live dont want to deal with my parents anymore. so i would like to file for emanciption

    in addition to that my house is the equivelent of an emotional warzone and the cps have given a warning so all hitting has stopped even though threats fly across the tabel back and fourth constantly (which is still physical abuse according to the health teacher) about a week ago my mother was venting towards me and i didnt answer a retorical question which resulted in my drink being thrown in my face and enduring an hour and a half of pure screaming. Im proud to say i stood there and took it remaining stoic and impassive the whole time, however, I do not wish to stay in a house like mine. My dad is NOT my biological father and my real dad is in cali. so no luck there because we just started talking, long story on that one. I am going to file for emancipation i can suport myself with a job but i am going to stay at a friends. If you could help me out and give me opinions that would be amazing.

    Emancipation isn't going to happen given the circumstances you've given...even if. If your legal guardian has given you permission to live elsewhere, that's all you need in order to leave and do so...understanding however that such guardian can revoke that permission at any time.

    A valid reason for emancipation would be, "My parents were both killed in a car crash and I need the legal authority to enter into contracts so I can pay the rent and the light bill and support my younger siblings".

    Not much short of that is going to fly.

    And, emancipation is only a TINY bit about the REASON, and a LOT about your ability to PROVE a history of SELF SUPPORT to the court. Without that history, or ability to prove that YOU can pay the MARKET RATE for self support, even the BEST reason the judge ever heard won't matter.

    Yes, as I stated emancipation is legal recognition of an already independent child, not the procedure for obtaining that independence. It allows the independent to do certain adult things (enter into contracts) that they are denied due to their age.
