    Default Marriage To A Foreign Citizen With Children

    Well, where to start with this one? Its a long story but i will try to keep it as short as possible.....I am an american citizen who just came back to the united states from germany.
    I had been living there for about 8 years. I had lost my job over there and had found a good job here, so here i am. While i was there... i got involved with a recently divorced german lady and we would like to get married. But there are lots of problems with this..

    1. She had gotten divorced from her husband because of spouse abuse reasons. He periodically beat her and her children. Now, she does have sole custody of all 3 children..(which by the way is extremely difficult for a women to get even under such circumstances)...and she has the right of the whereabouts of her children. In german (aufenthaltbestimmung recht)..So she is allowed to take her children and live wherever she wants without the consent of her former husband.

    2. What kind of paperwork would her and her children need to come here and live after we get married?

    3. What about schooling for her children? What are the laws on that? I mean they are required to take english courses in germany, its part of their schooling, but they would have to learn it fluently in order to be capable of going to school here, right?

    I know it might seem like its not right for her to take her kids thousands of miles away from their father, but believe me he is abusive. After i had left germany, he had showed up at her house and beat her so bad she was put in the hospital for a week. And now that i am here, he is constally harassing her and threatening her...etc...etc.... and she is terrified. I know I am carrying on but i want u to have the facts.

    Surely there must be a way for her and her children to come here. I would be very thankful for any advice or replies.

    Default German Laws & Custody

    The woman should speak with a custody lawyer in Germany, to make sure that her removing the children from that country would be permitted. I understand the background you have provided, but German courts historically prefer that German children be raised in Germany - and she should be aware from the outset if this could affect her custody orders.

    If you were to marry in Germany, you would apply for her to come into the United States on a K-3 spouse visa. You would apply for K-4 visas for any children under 21.

    Most U.S. school districts have ESL (English as a Second Language) programs of various sorts. Check with the schools in the area where you intend to live about their ability to accommodate German children with limited English language skills.
