    Angry Found Guilty of Driving Without Insurance by Default, but Innocent

    My question involves a driver's license issued by the State of: new york


    Please HELP ME
    approx 2 years ago i got pulled over and i was driving my employers van and i didn't have the current insurance id card and received a ticket for failure to produce insurance id card. got the new copy from my company and a letter saying that we have ever been without insurance for van... and sent all that in with ticket and plead not guilty... heard nothing and forgot about it....then got a letter 2 days before going on vacation saying i missed my court date and they found me guilty by default. didn't know anything about a court date? and freaked and went right away to tvb in NYC manhatten north and they told me there is nothing they can do as i have been found guilty...so not knowing the system i payed the 270.00 fine and 80.00 for restricted license and went on my way figuring i will be able to fix this and all will be good... wrong again! just recently got pulled over for making a wrong turn and the cop just gave me a ticket for not wearing a seatbelt instead telling me he is doing me a favor and there is no points for that...dont know only had 3 tickets in past 20+ years.
    then two days ago my boss calls me and tells me that his insurance company says my license is revoked and takes my truck away..and i go to dmv and they tell me i am revoked for getting a ticket on a restricted license and told me i have to pay a civil penalty 750.00 which i did only to find out after paying that i have to send another 100.00 to Albany to be reviewed and determined if i can have a drivers license??? i asked if i can go there to take care of this and she said no.

    i get payed by the hour and i am in the networking service business and without a license i am dead in water...no pay, food, house etc and i am out over 1100.00 and never drove without insurance!
    is there something i can do... please help

    Realistically speaking, the time to try to set aside the default was two years ago. You cannot expect that a court will revisit the ticket two years later, or that the DMV will particularly care that it did so in relation to the administrative penalties it has imposed.

    Thanks for the reply...when this happened i was told there is nothing you can do and got the restricted license..payed the 300+ dollars to get back to work...and also knew that i would have to pay an additional 750+ dollars at the end of my restricted period. i will caulk that off to not getting a second opinion from a lawyer first..as i am sure i could have had this fixed for 1200+ dollars. but they revoked my restricted license after i got a non moving violation and tell me i cant get my license back and will have to send another 100 dollars to a driver improvement place in Albany dmv and then based on there determination i can apply for a permit, drivers test etc..please remember i didnt get or have ever had any tickets since i was 17 ( 30+ years ago ) except, 1.talking on a cell phone and failure to produce insur id card,no seatbelt...no speeding..no points...no drinking

    i understand that hindsight is 20-20 but is there something i can do now?

    Move out of NYC area ? I avoid NYC like the plague ... nothing but scams occur in NYC, the the TVB as you have learned.
