    Default Car Sale Theft

    My question involves criminal law for the state of: Iowa

    A friend of mine owned a used car dealership and offered to sell my husbands truck for us. He sold the truck a month later for 5,000.00. He kept stalling us on the money and I later found out from a employee that he took the money and used it to pay bills at the business. He has given us only 400.00. I have a signed paper from him stating the sale of the vechile and to turn over the money and this was not a loan. He keeps making promises but its been a year and I am done waiting. Can I file theft charges against him or because I took the 400.00 it is now considered a loan and I am basiclly out.

    Can you file charges for theft almost a year after-the-fact? You can try, but I don't expect that the police will be very interested given the delay in the report.

    I suggest suing.
