Not to go off topic, but if the OP statement is indeed factual the LP made a "bad stop" by violating Wall-Mart policy concerning the confrontation and apprehension of shoplifters.*

Looks like someones trying to cover their butt.*

I would get a Market Manager involved very quickly. *

I cover my ass not sir, my original intent was to open the product, retrieve the item, place it in my pocket and go on with my day. Since I spotted the "LP" after i opened the seal and before i actually opened the package and retrieved the item i desired and placing it back on the shelf, Im not so sure if that would be considered shoplifting after reviewing the whole thing with a friend of mine's father whom happens to be an attorney. After carefully consideration I have decided im not paying them one red cent, If it comes down to it I never admitted to anything and they have but a surveilance tape in which clearly i am only damaging the item.
Then will i very politely tell walmart that they can procede to suck my balls...and i rest my case sir!

    Let me get this straight...

You opened the package. "after i opened the seal and before i actually opened the package and retrieved the item i desired and placing it back on the shelf,"

Answer this honestly....did you intend to shoplift?

It appears the OP was going to steal it by their own admission.

OP...here is the problem, the report is going to say you stole it and its your word against the LP. You will lose. I suggest paying the amount that you damaged and let it be. Don't pay the cd, pay the restitution. Ask for copies of the report etc through your lawyer.

Unfortunately, yes i did intend to i know stupid right but the thing is i did not all i did was tear the seal though, but i didn't actualy open it.

That would be the wisest thing to do i guess.

I'm in some what the same situation, except I was with a friend, and he took something, I was just there. I mean I really don't want to pay, but with trying to get a job and pay for college it might be my only choice! My question is how much was your civil demand and how long does it take to get a letter?
Any other tips somebody can give me would be much appriciated.
    Thank you.
